WHEREAS the Dr. Hamilton Crawford Memorial Centre Arena plays a crucial role as part of the social fabric of our community, serving as a central location and gathering space for youth sports, community events and social interactions – all of which contribute to fostering a sense of community belonging and well-being;

AND WHEREAS community organizations, local schools and hockey teams rely on facilities like arenas for physical activity and sport during the winter months, with limited alternatives in rural communities such as Marmora and Lake;

AND WHEREAS Municipally provided active programing like senior day skating, public family skating, and youth and adult shinny are accessible and community inclusive programs;

AND WHEREAS local businesses see economic benefit and spin-offs from seasonal ice bookings, tournaments and other events held at the arena during the operational season;

AND WHEREAS the Municipality of Marmora and Lake relies on annual revenue from ice rentals, events and hockey tournaments to help offset the operating costs of the arena, and the economic and social impact of not opening the arena would be detrimental to its future;

AND WHEREAS equipment at the Dr. Hamilton Crawford Memorial Centre Arena required for ice-making has experienced unexpected critical failure and requires immediate replacement for the arena to open and resume operations for the 2024-2025 season and beyond;

THEREFORE, be it resolved that the Council of the Municipality of Marmora and Lake support the application to the Community Sport and Recreation Infrastructure Fund (CSRIF) under the Repair and Rehabilitation Stream 1 for the Dr. Hamilton Crawford Memorial Centre Arena Project.

THAT the main motion be amended to remove the following from the final clause: "and that staff be directed to provide a report on the April 21, 2026, agenda, providing a summary of Council's interests and concerns regarding the Alto High Speed Rail Project, to be submitted by the April 24, 2026, commenting deadline;"

THAT the following be added between the second to last and last clauses: "WHEREAS the preliminary study corridor mapping released by Alto indicates that a potential route could pass through and impact the Municipality of Marmora and Lake;

WHEREAS there was no public consultation within the Municipality of Marmora and Lake and there was insufficient promotion to advise residents of opportunities to do so in other communities;

WHEREAS Alto was unwilling to hold an engagement session directly within the Municipality of Marmora and Lake, or appear before the Council of Marmora and Lake as a delegation with updated proposal changes and project developments;

WHEREAS Alto is, at this time, unable to provide complete and satisfactory answers to questions brought forward by Council, the public and municipal staff;

WHEREAS the currently identified study corridor would have significant potential long-term economic consequences within the Municipality of Marmora and Lake for local residents, including reduced property values, constraints on future land use, and impacts on agricultural land;

WHEREAS the proposed corridor raises serious concerns regarding impacts to agricultural operations and established farmland, crucial local waterways and environmentally protected areas, municipal roads, infrastructure and utilities, private property and recreational trails;

WHEREAS the proposed corridor would bring additional costs and negative effects to the levels of service provided by the Municipality, local organizations and businesses, including road plowing and maintenance, school busses and emergency vehicles, farming and agriculture, and local recreational trail networks;

WHEREAS both the short- and long-term local economic and socioeconomic benefits have not been made clear, nor has a community benefit agreement been presented or proposed;

WHEREAS there has been no timeline provided on release of a refined study corridor for the northern route passing through the Municipality of Marmora and Lake, leaving the Municipality and its residents in uncertainty;

AND WHEREAS the Municipality of Marmora and Lake supports responsible transportation infrastructure that strengthens regional connectivity while respecting and supporting the needs of local rural Ontario communities;"

AND FURTHER THAT the following be added after the final clause: "THAT this resolution be circulated to Alto, the Minister of Transportation, the local Member of Parliament, the local Provincial Member of Parliament, the Member Municipalities in Hastings County, the Association of Municipalities of Ontario (AMO), the Rural Ontario Municipalities of Ontario (ROMA), and Hastings County;

AND FURTHER THAT this resolution be submitted to the Alto engagement portal on behalf of the Council of the Municipality of Marmora and Lake."

WHEREAS section 391 (1) (c) of the Municipal Act, 2001, as amended,authorizes a Municipality to impose fees or charges on persons for the use ofits property, including property under its control;
WHEREAS the Municipality of Marmora and Lake's User Fee Bylaw 2024-21A,including Schedule E for Facility Rental Fees, does not include distinctions between private/for profit groups or community groups and organizations, nordoes it include reduced rates for those groups using municipal facilities forprograms offering wide community benefit to residents;
WHEREAS the Council of the Municipality of Marmora and Lake has beentasked with granting fee reductions and waivers of facility rental fees on anindividual basis, with no supporting policy, and now wishes to establish a fairand equitable decision-making process;
WHEREAS Council acknowledges and recognizes the value and benefit thatlocal Marmora and Lake volunteer groups and organizations bring to thecommunity at large through events, community-benefitting fundraisers, andprogramming for children, youth and seniors;
WHEREAS the residents of the Municipality of Marmora and Lake, through apublic engagement survey, indicated that they are, by vast majority, in supportof discounted rates for programs offered for children, youth and seniors, thatnearly all respondents are in support of discounted rates/fee waivers for “not-for-profit organizations,” and that fee waivers or discounts should be reservedfor local groups only;
AND WHEREAS Council wishes to encourage free and subsidized publicprograming and events that promote community spirit, education, health andwell-being by enhancing the quality of life for the residents of Marmora andLake, as well as allow residents access to important social services within theirown community;
THEREFORE, BE IT RESOLVED that the Council of the Municipality ofMarmora and Lake direct staff to develop a Municipal Facility Rental FeeWaiver and Reduction Request Policy and Application to support and appendthe User Fee Bylaw for community groups and organizations requesting use of municipal facilities for programs, community-benefitting fundraisers and special events.

WHEREAS the Council of the Municipality of Marmora and Lake has directed staff to develop a Municipal Facility Rental Fee Waiver and Reduction Request Policy and Application to support and append the User Fee Bylaw for community groups and organizations requesting use of municipal facilities for programs, community-benefitting fundraisers and special events;

WHEREAS staff followed the direction of Council under MOTION2024-350 and completed a public engagement survey related to facility rental fees (Schedule E of the User Fee Bylaw) and have presented the results to Council;

WHEREAS the public has been engaged, provided opportunity to participate in the survey and to provide additional feedback;

AND WHEREAS the staff report "Municipal Facility Rental Survey Results," dated March 4th, 2025, recommends that Council provide direction to staff about related updates to the User Fee Bylaw;

THEREFORE, BE IT RESOLVED that Council direct staff to include within the Municipal Facility Rental Fee Waiver and Reduction Request Policy and Application, at minimum, the following sections: Policy Statement, Scope, Definitions, Application Procedure, Conditions, Eligible and Ineligible Applicants, Application Form;

THAT the policy be drafted to include the following facilities belonging to and operated by the Municipality of Marmora and Lake, exclusively: the Community Centre (Lions Hall), Community Hub, William Shannon Room, Deloro Hall, and fairgrounds;

THAT the following requirements be met by all applicants:

         That the applicant be a Marmora and Lake-based group/organization, unless the program/event primarily benefits the residents of the Municipality of Marmora and Lake, or the applicant is providing a social service;

         That the applicant is in good financial standing with the Municipality of Marmora and Lake as it relates to previous facility rentals;

         That the applicant fulfilled all of their obligations for previous programs/events for which fees were waived or reduced;

         That the application be submitted within the required timeline as established by staff in the policy;

         That a fee waiver or reduction not be combined with any other existing reductions within Schedule E of the User Fee Bylaw;

THAT applications be required to meet a minimum of two (2) of the following criteria:

         Demonstrate that the applicant involves volunteers, and offers programs which address identifiable needs in the community, or which bestow benefit to the general community and residents of the Municipality of Marmora and Lake;

         Demonstrate a clear need for the waiver/reduction being requested in order to enable the organization or group to provide the specific program/initiative/event;

         That the program/event promotes education, health and/or well-being by enhancing the quality of life for the community and its residents;

         That the program/event is specifically offered for children, youth, seniors or vulnerable population(s);

THAT the policy include two options: a fee waiver or a 50% fee reduction;

THAT, to qualify for a Fee Waiver, the program/event must be free of charge, open to the public, and does not offer items for sale or purchase, while a 50% Fee Reduction is available for applicants who meet the criteria details above but charge an admission fee, membership fee, due and/or offer items for sale or purchase.

THAT the following conditions be required of ALL successful applicants for fee waivers and reductions:

         That the ratepayers of the Municipality of Marmora and Lake be named in any promotional materials for the program/event;

         That all applicant organizations/groups each be limited to a maximum cumulative waiver/reduction of $1,500.00 annually;

         That the applicant not sublet the rented facility to other persons or groups;

THAT municipal staff or Members of Council may bring forward completed applications of exceptional circumstance or emergency for Council consideration above and beyond the policy when deemed necessary;

THAT, notwithstanding, organizations/groups with existing agreements with the Municipality outside of this policy, being the Marmora Crowe Valley Lions, the Marmora Agriculture Society, and the Marmora and Area Curling Club;

AND FURTHER THAT a report summarizing granted waiving and reduction of fees be presented to Council on an annual basis.
